1. Acceptance of Terms

By accessing or using kwale.ai ("the Service"), operated by Kwale AI LLC. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

kwale.ai provides AI-powered computational neural scoring and content generation services. Our models predict potential brain responses to media content using machine learning trained on aggregated, anonymized neuroscience research data. The Service is provided "as is" and "as available."

3. Brain Prediction Disclaimer

Important:kwale.ai's neural scores are computational predictions generated by AI models. They are not medical diagnoses, clinical assessments, or direct measurements of any individual's brain activity. Our predictions are statistical estimates based on aggregated neuroscience research data and should not be used for medical, diagnostic, or clinical purposes. Results represent population-level trends and may not reflect individual responses. Do not make health-related decisions based on kwale.ai outputs.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5. Acceptable Use

You agree not to:

• Upload content that infringes on intellectual property rights of others.
• Use the Service to generate, promote, or distribute harmful, illegal, or misleading content.
• Attempt to reverse-engineer, decompile, or extract the model weights or training data.
• Use the Service for medical, diagnostic, or clinical purposes.
• Exceed rate limits or abuse the API in ways that degrade service for other users.

6. Intellectual Property

You retain ownership of all content you upload. We retain ownership of all models, algorithms, scoring methods, and platform technology. By using the Service, you grant us a limited license to process your content for the purpose of providing the Service.

7. Payment and Billing

Paid plans are billed monthly or annually as selected. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Free tier usage is subject to fair-use limits.

8. Limitation of Liability

To the maximum extent permitted by law, Kwale AI LLC. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your account at any time. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration.
